Terms and Conditions – DFW Appliance Leasing
Please read these terms and conditions (“Terms”) carefully before using our appliance leasing services. These Terms apply to all users, customers, and lessees (“you” or “your”) who engage in leasing appliances from our business (“we,” “us,” or “our”). By using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using our services.


Lease Agreement

1.1. By entering into a lease agreement with us, you acknowledge that you are at least 18 years of age and have the legal capacity to enter into a contract.
1.2. The lease agreement is binding once you accept the terms, select the appliances, and provide the necessary payment information.
1.3. The lease term will be specified in the agreement, and you must return the appliances at the end of the lease period, unless otherwise agreed upon.
1.3.1 Appliances are rented out on a month-to-month basis, unless otherwise specified.
1.3.2 Lessee must give 14 days notice of ending the lease agreement.
1.4. The appliances remain our property throughout the lease term and cannot be sold, subleased, or modified without our prior written consent.
1.5. We reserve the right to terminate the lease contract for any reason, and at any time as well as have the appliances returned with 5 business days.

Appliance Selection and Availability

2.1. The selection of appliances is subject to availability.
2.2. We strive to provide accurate and up-to-date information regarding appliance availability, but we do not guarantee the availability of specific models or brands.
2.3. In the event that a selected appliance becomes unavailable, we will make reasonable efforts to provide a suitable alternative or inform you of the unavailability and refund any associated fees.

Payments

3.1. You agree to pay all applicable fees, including but not limited to lease fees, delivery fees, and taxes, as outlined in the lease agreement.
3.1.2 Prior to DFW Appliance Leasing delivery your appliances, payment must be made in full for the first month, the delivery and installation fee, and any applicable taxes.
3.2 The start date of the lease will commence Payment will be automatically made every month (30 days) from the start of the lease with the debit/credit card on file.
3.3. Payment must be made in US Dollars and using the provided payment methods.
3.4. Late payments will result in additional charges, suspension of services, or termination of the lease agreement.
3.4.1 A 5 business day grace period will be provided on late payments. After 5 business days, a $50 late fee will be assessed. If a payment is more than 30 days late, the lessee will be considered in default and will be responsible for the fair market value of the appliance unless the appliance is returned in good working condition, normal wear and tear excepted.
3.5. All fees are non-refundable unless otherwise specified.
3.6. A cleaning fee of $40 will be assessed if the appliance is returned excessively dirty, which includes but is not limited to: Heavy lint in filter trap or inside the dryer, mold growth and/or dirt in the door boot of the washer, detergent spilled on the machine.

Delivery, Installation, and Maintenance

4.1. We will arrange delivery and installation of the leased appliances to the specified address, subject to the availability of delivery services in your area.
4.2. It is your responsibility to ensure that the delivery address is accurate and accessible.
4.2.1 A one-time delivery and installation fee of $49.99 will be assessed at the beginning of the lease. Any additional delivery attempt will incur another delivery and installation fee of $49.99.
4.3. You are responsible for the proper use, care, and maintenance of the appliances during the lease period.
4.4. Any damages or malfunctions caused by improper use, neglect, or unauthorized repairs may result in additional charges for repair and/or the termination of the lease agreement.
4.4.1 Infestations – If the unit is found to have an infestation, lessee will be responsible for either replacement of the unit or required repairs, whichever DFW Appliance Leasing sees fit.
4.5 Maintenance will be taken care of by DFW Appliance Leasing. If an issue occurs, let us know within one business day.

Liability and Insurance

5.1. You are responsible for any loss, theft, damage, or destruction of the leased appliances, except for normal wear and tear.
5.2. It is your responsibility to maintain appropriate insurance coverage for the appliances during the lease term.
5.3. We are not liable for any indirect, incidental, consequential, or punitive damages arising out of the use or inability to use the leased appliances.

Termination

6.1. DFW Appliance Leasing reserves the right to terminate the lease for any reason at any time subject to any applicable termination fees specified in the agreement.
6.1.1 Lessee must provide 14 day notice of termination of lease by phone or by email at accounts@dfwapplianceleasing.com
6.1.2. In the event of early termination by you, you will be responsible for any remaining lease fees and applicable charges for that month.
6.2. Upon termination, you must return the appliances in good working condition, normal wear and tear excepted.

Privacy and Data Protection

7.1. We will collect and process personal information in accordance with applicable data protection laws and our privacy policy.
